As a real place for dialogue accessible to everyone, the forum is an area for mutual help and discussions provided by the Hosting service provider, which enables the users to discuss about the main topics of the game Stellar Overload.
The present charter of use (hereinafter referred to as the “Charter”) aims to detail the forum conditions of use and the rules which apply to it. The forum forms part of the www.stellar-overload.com website and any user publishing on this forum undertakes, within the framework of its released content, to respect the clauses of the website General Terms of Use within the General Sales Conditions, viewable here
The terms defined hereinafter, whether used in the singular or in the plural, have, in the present Charter, the meaning indicated below:
Any User can have free access without payment to the Forum and its content.
Access to the Forum, in order to participate actively and to write Contributions, is protected through a personalized User account. In order to create such an account, the User shall register on the Forum by giving the following information:
The email address will be used for the follow-up of discussions. Thus, the User shall receive publication alerts each time a new Contribution is posted in the discussion in which the User took part. Within this framework, the User shall also receive messages from the Administrators.
However, any User should register only once on the Forum: multiple registration under different pseudonyms is forbidden.
The use of famous people's names, trademarks or well-known products by the User, implies the Moderators to change the User’s name in order to ensure that the rules set forth by the present Charter are respected.
Furthermore, the User’s choice to register with his/her real name may not incur the Hosting service provider’s responsibility towards third-parties.
During the registration process, the User will systematically be registered as a User or as a Backer if this User participated to the Kickstarter Planets³ campaign.
The User shall give the User login and password in the space provided for such purpose, in order to access the Forum.
If the User wishes to register his/her login and password on the Forum, a persistent cookie will be placed on the User’s computer. The primary purpose of this cookie is to simplify the Users access to the Forum by removing the phase of input of the login and password. At the end of each online session, the User should log-off from the Website if the User accessed the Website from a public computer, in order to make sure that no third-parties could send messages unwittingly.
The User may, if he/she so wishes and only on his/her own initiative, chose to make his/her User’s email address, first and last name public. However, the Forum shall in no case be held liable for the consequences related to this disclosure.
Finally, a User owning an account may ask to the Forum’s Administrators some modifications of his/her account if the User is not able to achieve these modifications alone through the management tools at his/her disposal. For this purpose, the User shall complete the support form with the purpose and the justifications of the request at the following address: https://www.stellar-overload.com/contact.html.
The Hosting service provider owns the entire property of the website structure hosting the Forum, and the technologies set for its development (including, but not limited to, texts, downloadable documents, images and icons, shaping processes, corporate identity style guides, databases, scripts…).
The advertising banners and partners' logos, as well as any other reference, remain the property of their authors and external firms.
Any reproduction or recording of any kind or on any support whatsoever is subject to the Hosting service provider’s using license.
The Contributions posted on the Forum should be written in a correct language and understandable by everyone.
In order to ensure a maximum legibility, the use of lowercase letters is strongly recommended. Indeed, the capital letters or the accentuation of punctuation marks may be interpreted as the User shouting which is harmful for the effective functioning of the Forum.
The title of the Contribution posted on the Forum should be as clear and understandable as possible in order for a maximum of Users to be able to answer. The title should also contain keywords and be very precise for Users to understand the encountered problem. Moreover, it seems important to write a Contribution clear and precise, but also complete, in order to encourage other Users to respond.
Concerning the response to a User’s Contribution, it can be useful to quote a part of the original text in order to explain the context of this Contribution and to be better understood by the Users. However, it is useless and counterproductive to copy the whole conversation in the answer.
Besides, bringing a topic to the top of a discussion on the Forum is considered spam.
All Contributions posted on the Forum shall respect the present Charter, and shall especially:
By consequence, the Users are invited to adopt a respectful attitude towards one another.
Finally, in the case where several discussions are launched on the same topic, the Moderators can let one of them open and close the others discussions by providing explanations. The conversation which remains open to discussion will be chosen on the basis of the number of Contributions it contains, of the tone employed in the discussion and of the usefulness of the Contributions. This process enables the Forum to keep containing diversified topics.
The Contributions which do not respect those rules shall be deleted by the Moderators, following the moderation process described at article VIII of the Charter.
All the topics of discussion and the User’s Contributions are public communications likely to be referenced on a search engine and therefore, be viewed by external audiences than the Users. By consequence, the information that the User wishes to keep private shall not be mentioned on the Forum. As a precautionary measure, those elements may be deleted by the Administrators and Moderators.
Each Reader shall respect the authors’ intellectual property rights. The Reader shall not reproduce and release the Contributions published on the Forum on other forums or supports, without the prior consent of their authors.
However, any User is entitle to reproduce the Contributions posted on the Forum for the purposes of private consultation, or to reproduce and release short extracts from a Contribution, for the purposes of information of research, by quoting the name of the Forum and the name of the Contributor (real name or pseudonym).
Each Contributor is the owner of the Contribution he/she published and of the intellectual property rights attached. Thus, every Contributor is responsible for his/her messages on the Forum, these messages are publically published under the Contributor’s own responsibility.
The Contributors have been informed that the information they want to keep private or confidential should not be posted on the Forum.
The participation to the Forum grants the Contributors quotation rights, that is to say the right to publish a short quotation extract necessarily accompanied by an indication of the author and source names as well as the right to create links to the Forum, without neglecting to distinctly quote the source, as well as the deep links.
However, the reproduction and disclosure, on any support, other than for a personal use, for commercial purposes or not, of the Administrators and Moderators Contributions are submitted to their prior written consents.
The Hosting service provider does not guarantee the accuracy of the Contributions posted on the Forum, neither support the opinions which could arise: the statements expressed on the Forum are the personal opinions of the respective Users.
Besides the Hosting service provider shall not be subject to civil liability because of the User’s statements. Users are the only responsible for the content and use of these statements. Thus, the Users shall guarantee the Hosting service provider against any third-party claims relating to the content of the User’s Contributions.
The moderation process within this Forum aims to ensure that the User’s remarks comply with laws and regulations in force and with rules set out by the present Charter. The consequence of this moderation will be the moving of the remarks to a more appropriate section or the refusal in part or all of the publication of a User’s remark on the Forum.
The Moderators retain the right, at their sole discretion, to delete any Contribution which does not comply with the present Charter, especially the Contributions not compliant with the article V of the Charter.
Thus, the Users shall report an abusive Contribution by clicking to the link « report abuse » contained at the bottom of every Contribution for this express purpose.
Pursuant to the article 39 of the Data Protection Act of January 6th 1978, as modified by law of august 6th 2004, any User has a right to access, modify, correct and delete his/her personal data and has a right to object to the use of these personal data for direct marketing purposes.
Thus, Users can at any time ask to modify or suppress their Contributions by filling in the assistance form via the following link: https://www.stellar-overload.com/contact.html, and by indicating the following elements: title and date of the Contribution’s publication, name or pseudonym which has been used and URL. Requests are processed within a minimum period of one (1) month and shall not exceed three (3) month.
The sanctions for non-compliance with the Charter, after cautions and warnings from the Administrators, can result in the suspension of the User’s account for at least 3 days. Repeated suspensions or simultaneous breach of the Charter’s rules shall lead to a longer suspension of the User’s account, from six (6) days to fifteen (15) days.
Repeated misuse by a User may lead to a permanent expulsion from the Forum decided by the Administrators.
The Charter hereof is exclusively subjected to French law.
The official language hereof is French. The use of any other language is only informative. In case of difficulty relative to the Charter, the Parties shall refer exclusively to the French text.
Any dispute concerning the validity, construction, performance, or non-performance of the Charter shall be submitted to the competent Court in the location where the Hosting service provider has its registered office.
The present clause applies, except otherwise provided by law, without prejudice to the Hosting service provider rights to prosecute anyone who violates its rights before any Court that would have jurisdiction in the absence of the above-mentioned clause.
